FollowGap is a tool that helps users analyze their Instagram follower and following relationships. The Service allows users to identify accounts they follow that do not follow them back, and provides functionality to manage these relationships. The Service operates by interfacing with Instagram's platform using credentials you provide.

3. User Responsibilities

By using the Service, you acknowledge and agree that:

You are solely responsible for your Instagram account and any actions taken through the Service
You will provide your own Instagram authentication credentials to use the Service
You will use the Service in compliance with Instagram's Terms of Service and Community Guidelines
You will not use the Service for any unlawful purposes or in any manner that could damage, disable, or impair the Service
You understand that automated actions on Instagram may be subject to rate limits or restrictions
You are responsible for any consequences resulting from your use of the Service, including any actions taken on your Instagram account

4. Third-Party Services

The Service interacts with Instagram, which is a third-party platform owned by Meta Platforms, Inc. We are not affiliated with, endorsed by, or sponsored by Instagram or Meta. Your use of Instagram through our Service is subject to Instagram's own Terms of Service and Privacy Policy. We are not responsible for any changes to Instagram's platform, API, or policies that may affect the functionality of our Service.

5. Automation, Rate Limits, and Account Protection

The Service may perform automated actions on your behalf, such as retrieving follower/following lists and unfollowing accounts. To protect your Instagram account, we have implemented intentional safeguards:

Automated actions are performed at your explicit request and direction
We intentionally throttle data fetching speeds to reduce the risk of triggering Instagram's rate limits or automated detection systems
Data retrieval may take longer than expected—this is by design to keep your account safe from restrictions
We implement reasonable delays between API requests to minimize the risk of account restrictions
Instagram may impose their own limitations on automated activity regardless of our precautions
Your account may be subject to temporary or permanent restrictions by Instagram as a result of automated actions, even with our protective measures in place
We are not liable for any account restrictions, suspensions, or bans resulting from your use of the Service

Why is data fetching slow? We prioritize the safety of your Instagram account over speed. By intentionally pacing our requests, we significantly reduce the likelihood of Instagram flagging your account for suspicious activity. While this may result in longer loading times, it helps ensure your account remains in good standing.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless FollowGap and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also delete your account at any time through the account settings page.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
